Terms of Service
The agreement between you and {{COMPANY_LEGAL_NAME}} for the use of Rankfinity — the application at app.rankfinity.app, its API, its MCP server, its browser extension and its WordPress plugin.
Pending legal review — not legal advice. These terms describe how the service works today and were prepared by us; they are being reviewed by a qualified lawyer. Where they conflict with mandatory law of the country you live in, that law prevails.
The short version (the full text below is what counts):
- Rankfinity is a professional tool for people aged at least 18 acting for a business.
- Every tool is on every plan, including the Free plan. Plans differ only in their limits.
- Paid work is metered in credits. Credits are not money; section 6 says exactly when each kind ends.
- Paid plans renew automatically until you cancel; you can cancel online at any time.
- Consumers in the EU and the UK have 14 days to withdraw from a purchase (section 8).
- You are responsible for the sites you crawl, the people you email and the content you publish.
- No ranking, traffic or AI-answer is guaranteed, and AI output must be reviewed before use.
- Bulgarian law applies; consumers keep the protection of the law where they live.

1 · Who you are contracting with
The service is provided by {{COMPANY_LEGAL_NAME}}, a company registered in the Republic of Bulgaria, with its registered office at {{COMPANY_ADDRESS}}, company / VAT number {{COMPANY_VAT}}, represented by {{COMPANY_REPRESENTATIVE}}. "We", "us" and "our" mean that company. "You" means the person or organisation that holds the account; if you accept these terms for an organisation, you confirm that you are authorised to bind it, and "you" means that organisation.
By ticking the box at sign-up, by accepting a changed version in the application, by paying at checkout, or by using the service, you accept these terms and confirm that you have read the Privacy Policy. If you do not accept them, do not use the service. We store the date and the version of the text you accepted (section 22).
The agreement consists of these terms, the Acceptable Use Policy, the Refunds and cancellation page, the plan, price and credit information shown to you before a purchase, and — for personal data you load about other people — the Data Processing Agreement. On the processing of personal data the Data Processing Agreement prevails; on everything else these terms prevail. Related pages: Sub-processors, Cookies, Security, Copyright and abuse and Accessibility.
The public marketing site at rankfinity.app is informational and links to these pages. A contract is made only in the application: at sign-up, and at checkout for anything paid. Written notice to us goes to {{CONTACT_EMAIL}}; written notice to you goes to the email address on your account, so keep it current.
2 · What the service does
Rankfinity is a toolkit for search-engine optimisation, local search and AI visibility. It includes:
- Rank tracking — scheduled and on-demand position checks for the keywords, locations and devices you configure, and local map-grid scans that show where a business appears in map results across a grid of points you define.
- Site audit — a crawler that fetches pages of a website you nominate and reports
technical and on-page findings, including checks of how ready a site is for AI assistants and
agents (for example
robots.txtrules,llms.txt, structured data and related DNS records). - Research — keyword, domain, competitor, content-gap and backlink data.
- AI visibility — it sends questions you configure to third-party AI assistants and AI search features and records whether a brand was mentioned or cited in the answers.
- Connections — optional connections to Google Search Console, Google Analytics, Google Business Profile and Bing Webmaster Tools, and indexing tools (IndexNow submissions and index checks).
- Content Writer and the WordPress agent — AI-assisted drafting and, through our WordPress plugin on a site you control, changes to that site that you request.
- Link Builder — finding sites for links and, where switched on, outreach email to their owners on your behalf (section 10).
- The assistant and ready-made skills — in the application and through AI clients you connect over MCP.
- Reporting — reports, alerts, scheduled emails, read-only share links, client access and white-label branding (section 12); webhooks to your own systems and a browser extension, where they are switched on.
Data comes from licensed data providers, from AI providers, from the Google and Microsoft services you connect, and from our own requests to public web pages: our crawler, single-page checks, and — for a few checks such as whether a page is indexed — public search-result pages, within strict limits. The providers are described on the Sub-processors page.
The public site also offers free tools that work without an account; they follow the Acceptable Use Policy, and their limits are shown on each tool. Features marked as beta or preview, and features we switch on for some accounts first, may change or be withdrawn without the notice in section 21.
3 · Your account and eligibility
- You must be at least 18 and, if you accept on behalf of a company, authorised to bind it. The service is not directed at children and we do not knowingly open accounts for them; if we learn that one exists, we close it and delete its data.
- The service is for business and professional use. By creating an account you confirm that you act for a business or professional purpose. If you are nevertheless a consumer under the law of your country, the mandatory consumer rights described in these terms and on the Refunds page apply to you and nothing here removes them.
- Accounts can be created by anyone while public sign-up is open, and otherwise by invitation. Which of the two applies is shown on the sign-in screen. Some actions, such as spending credits, may require a confirmed email address.
- Sanctions and export controls. You may not use the service if you are located in, or ordinarily resident in, a country or region under comprehensive sanctions or embargo, if you appear on a sanctions list of the European Union, the United Nations, the United States or the United Kingdom, or if you act for such a person; and you may not use it for a military end use. We may refuse or close an account to comply with such rules.
- Teams. The account owner can invite colleagues into the workspace. Members of a workspace share the owner's plan and credit balance; what they do is done under the owner's account, and the owner is responsible for it. Users with the client role see the results of the agency that invited them; billing stays with the agency.
- Each login belongs to one person. Do not share passwords, API or MCP tokens; invite colleagues instead.
- Passwords are stored only as an Argon2id hash and cannot be recovered — only reset. Two-factor authentication is available in account settings; if you handle client data, turn it on. Your account screen lists your active sessions and lets you end all the others. Tell us promptly at {{CONTACT_EMAIL}} if you think someone else is in your account.
3a · How we use your usage data
To run the service we record how it is used: your actions, the credits they cost, sign-in events, and which screens are used. We use this to operate the service, to bill and keep your credit ledger, to keep accounts secure and prevent abuse, to give you support, and to improve the product. Our staff see only what those purposes need, and when an administrator opens your account in the admin panel the view is written to our audit log. If support needs to see what you see, the "view as" session is read-only, ends after 30 minutes, needs a stated reason, is logged, and is listed to you in the application under Account › My log › Support access. Staff can never read your Google tokens, your payment details or your provider keys, and the Search Console, Analytics and Business Profile screens are blocked in support sessions. The details, the legal bases and the retention periods are in the Privacy Policy.
4 · Licence, API, MCP and integrations
While your account is in good standing we grant you a limited, non-exclusive, non-transferable, revocable licence to use the application, the API, the MCP server, the browser extension, the WordPress plugin and, where you install it from the Shopify App Store, the Shopify app, for your own business and for the businesses of your clients, in line with your plan and these terms. All other rights are reserved. The same rules, limits and prices apply however you reach the service.
- Tokens are credentials. MCP tokens, WordPress plugin keys, webhook secrets and any API key are shown once; keep them secret. What is done with them is done by you. You can see and revoke your MCP tokens under Account › MCP.
- AI clients over MCP. A new MCP connection can only read. If you switch on "Allow changes", the AI client you connected can also make changes and start paid actions in your account; paid tools first return the price and run only when the client confirms that exact price. Actions through MCP are subject to a daily credit cap per account, shown under Account › MCP. You are responsible for the AI client you connect and for what it does on your instruction, including its mistakes.
- Ready-made skills. Skills run a method of ours on your data and return the result. The method stays on our servers and is confidential (section 14). Requests that try to extract it are refused, are not charged, and are recorded without their text.
- WordPress plugin. Install it only on a site you control or are authorised to change. It acts on that site when you ask it to, with the permissions you give it; keep backups of your site.
- Webhooks and other destinations you choose. If you add a webhook endpoint, an email server or another destination, we send the data you selected to it. You are responsible for that destination and for what happens to the data there.
- Browser extension. Where it is published, it audits the page open in your browser and, if you sign in, reads your account with a read-only token.
- Users with the client role act inside the workspace of the agency that invited them; the agency is responsible for them.
- You may not sell, sublicense or hand over access to the service itself, or offer it as a competing product. Using it to serve your own clients — reports, client access and white-label output (section 12) — is allowed.
Shopify app. Where you install Rankfinity from the Shopify App Store, the Shopify app is part of the service, and these terms apply to it together with Shopify's terms. It reads the parts of your store described in the Privacy Policy, section 3b, and it writes to your store when you approve a change. Autopilot and automatic image optimisation are off by default; if you switch one on, it writes the changes you chose to automate, within the limits the app shows you (for Autopilot, a monthly credit cap that you set).
Partner platforms. A partner platform may create a Rankfinity account for you and sign you in through a one-time link. Its own terms apply to you alongside these, and the data it sends us is described in the Privacy Policy, section 3c.
5 · Plans and limits
Every tool is available on every plan, including the Free plan. Plans differ only in their numbers: for example the number of projects, keywords, locations and team seats, the monthly credits, the pages per crawl, how often scheduled work may run, the daily MCP credit cap and the number of assistant messages. The numbers for each plan are shown in the application (Compare plans) and before you pay. Some tools used only to operate the service, such as our internal data explorer, are not part of any plan.
Some recurring work is included in a plan within its limits and costs no credits — for example scheduled tracking at the frequency your plan allows. What is included and what costs credits is shown next to each action in the application.
The Free plan costs nothing and needs no card. It includes a monthly allowance of free credits, shown in the plan list. We may change the limits of the Free plan, or end it, by telling existing Free accounts at least 30 days before; your data stays yours to export.
Limits are enforced by the application. Reaching a limit stops the action that would exceed it; it never charges you more than the price shown.
6 · Credits
Paid work inside the application is metered in credits. The price of each action is shown in the price list and before the action runs. The mechanism decides what you are charged when something goes wrong:
- Before an action runs, the application estimates its cost and reserves that many credits from your balance.
- When the action finishes, the reservation is settled at the amount actually used, never above the estimate, and the difference is returned to your balance.
- If the action fails, or a provider returns nothing usable for a reason that is not yours, the reservation is released in full. You do not need to ask.
An action that returns a result you did not like is still a result and is charged. Every movement is written to a credit ledger you can read, and export as a spreadsheet, from your account screen. If the ledger and your expectation disagree, the ledger is the record we will both look at.
When credits end
| Kind | How you get them | When they end |
|---|---|---|
| Free plan allowance | At sign-up, and on the first day of every calendar month (UTC) while you are on the Free plan. | At the end of that calendar month. Unspent free credits are not carried over. |
| Paid plan allowance | At the start of each billing period, when the payment for it succeeds. | At renewal: unspent plan credits are not carried over and the new period starts with a fresh allowance. All plan credits end when the plan ends. |
| Trial credits | During a trial of a paid plan, where one is offered: part of the plan's allowance. | When the trial ends. The full allowance follows with the first payment. |
| Top-up packs | When you buy them. | They do not expire, unless the pack said otherwise before you bought it. |
| Referral, partner and promotional credits | Under the programme or offer that granted them (section 9). | They do not expire. They can be withdrawn if they were obtained in breach of these terms. |
Credits that end soonest are always spent first. Credits are a unit of account for using this service. They are not money, are not a deposit, carry no interest, cannot be exchanged for cash and cannot be transferred to another account (members of one workspace share one balance). They are not refunded except as the Refunds page or the law provides. When an account is deleted, the credits in it end with it.
We may change the credit price of an action. A new price applies only to actions started after the change, and is shown before the action runs; it does not change the number of credits you hold.
7 · Subscriptions, payment and taxes
- A paid plan is a subscription that renews automatically every month or every year (the period you chose) until you cancel. The price, the credits included, the billing period and, for a trial, the date it ends and the price that follows are shown before you enter your card, in the plan list and at checkout.
- You can cancel at any time, online, under Billing in the application, which opens the payment provider's customer portal. Cancellation takes effect at the end of the period you have paid for: you keep the plan until then and nothing more is charged. Plan changes take effect as the portal shows when you make them.
- We email you before a plan renews — about 7 days before a monthly plan and about 30 days before a yearly one — and before a trial converts to a paid plan.
- Trials. Where a trial of a paid plan is offered, it is shown at checkout. It converts to the paid plan at its end unless you cancel before. During a trial you receive part of the plan's credits and top-up packs may be unavailable. A trial is for one person or organisation once; we may refuse a trial to accounts that appear connected to one that has already had it.
- Failed payments. If a renewal payment fails we tell you and the payment provider tries again. If it still fails, the subscription ends, the account returns to the Free plan, and the plan credits end.
- Price changes. We do not change the price of a period you have already paid for. A new price applies from the next renewal after we have told you at least 30 days earlier by email, and you can cancel before it applies.
- One-off purchases — top-up packs and one-off products such as an AI visibility audit report — are paid once and do not renew.
Shopify installs. Where you installed Rankfinity from the Shopify App Store, Shopify bills the subscription and the credit packs bought in the app, under Shopify's billing terms, and Shopify issues the invoice. Cancellation, plan changes and refunds for those charges follow Shopify's billing rules as well as these terms, and Stripe is not involved in them.
Prices, taxes and invoices. Prices are shown in the currency of the plan, and checkout states whether tax is included. Value added tax or sales tax is added where the law requires it. If you are a business in the European Union and give us a valid VAT number, the reverse-charge rules apply where they are lawful. Each payment produces an invoice or a receipt from our payment provider, which you can open from the Billing screen. Other payments are processed by Stripe; we do not see or store your full card number.
8 · Refunds and the right to withdraw
The full rules are on the Refunds and cancellation page, which is part of these terms. In short:
- Consumers in the European Union, the EEA and the United Kingdom may withdraw from a purchase within 14 days without giving a reason. Because the service is digital and starts at once, we ask before it starts for one statement, in a single tick-box: that you expressly request the service to begin immediately, and that you acknowledge that you lose the right to withdraw once the service has been fully provided. If you withdraw after asking for an immediate start, you pay a proportionate amount for what was provided up to that moment. If you did not give the statement, withdrawing within the 14 days costs you nothing.
- Apart from that right and other rights the law gives you, payments are not refunded: not for the part of a period you have used, and not for credits you have spent. If a payment was taken in error or twice, or the service failed for a reason on our side, we put it right.
- If we end the agreement without a breach by you, or you end it because we breached it, we refund the unused part of what you prepaid, at the price you paid.
The same rights apply to charges billed through Shopify. Write to us at the address in section 29, and we tell you what we can refund and how.
9 · Referral and partner programmes
Referrals
- Your account has a personal invitation link. A person who creates a new account through it receives sign-up bonus credits. You receive reward credits once, when that person pays their first invoice for a plan. The amounts are shown on your Referral screen. Only the direct invitation is rewarded; there is no reward for people invited by the people you invited.
- Nothing is credited for inviting yourself, your own workspace or someone who already has an account.
- Checks. Before a reward is credited, the payment of the invited account is compared with the inviting account: the card, the cardholder name, a company email domain, the network address at sign-up and the browser. A match sends the reward to review by a person instead of paying it automatically. A card that has already brought a reward does not bring another. If a reward is refused because of a matching card or cardholder name, the invited account's sign-up bonus may be removed, to the extent it has not been spent.
- Referral credits are promotional credits under section 6. They have no cash value.
Partner (affiliate) programme
- A partner earns a commission — the percentage and the period shown on the Affiliate screen — on what the customers they bring pay us. A customer counts for the partner whose link they last followed before signing up. The link is recorded in a cookie only with your consent (see the Cookies page); otherwise it travels with the sign-up itself.
- Each commission waits for a hold period (the refund window shown on the Affiliate screen) before it is approved. A refund or a payment dispute reverses the commission on that payment while it is pending or approved; a partial refund reduces it proportionately.
- Commissions are paid as credits, which do not expire, unless we have agreed in writing to pay a partner in money. A partner paid in money gives us correct payout details and tax information on request, is responsible for their own taxes, and is paid once the approved amount reaches the minimum shown on the Affiliate screen.
- No commission is earned on yourself, your own team, someone with the same company email domain, or disposable email addresses. Sign-ups that look connected are held for review by a person.
- Partners must make clear to their audience that they may earn a commission, must not make misleading claims about the service or its prices, must not send unsolicited email or messages to promote it, and must not present themselves as us.
We may change or end either programme for the future, with notice in the application. Rewards already credited stay credited. We may refuse, reverse or withdraw a reward or a commission that was obtained in breach of this section or the Acceptable Use Policy, and we may close a partner account that breaks them; unpaid commissions on such an account are not paid.
10 · Acceptable use
You must follow the Acceptable Use Policy. Its most important rules:
Crawling and auditing other people's sites
You may point the crawler only at a website you own, or one you are authorised by its owner to audit. By starting a crawl you confirm you have that authority. If you are an agency, that authority comes from your client — get it before the first crawl, not after the first complaint.
The crawler reads robots.txt and respects it, identifies itself in its user agent,
paces its requests, and skips pages that are too large. You must not attempt to defeat any of that,
and you must not use the service to place load on a third-party site. Single-page checks of a public
page (for example an on-page check) read only what any visitor would see.
Outreach email
If you use Link Builder or any other feature that sends email on your behalf, you are the sender in law and you are responsible for lawful use: you may write only to people you may lawfully contact, you must identify yourself truthfully and give your postal address where the law requires it, you must honour every opt-out, and you must follow the anti-spam and e-privacy rules that apply where the recipient is — including, in the European Union and the United Kingdom, the limits on unsolicited email to individuals and sole traders. We may add limits, suppress addresses and stop a campaign at any time, and we keep a suppression list of addresses that must not be contacted.
What you publish
You are responsible for everything you publish, send or submit with the service — pages and posts published through Content Writer or the WordPress agent, outreach email, review replies and Business Profile posts. Check facts, claims, rights in text and images, and the rules of the platform you publish to before you publish.
11 · Your content and other people's data
What you put into the application — project names, domains, keywords, coordinates, competitor lists, report branding, and the results produced from them — stays yours. You grant us only the licence needed to run the service for you: to store that content, send the necessary parts of it to the providers named on the Sub-processors page, and display it back to you and to anyone you share it with. We do not sell it and do not use it to build something for somebody else. Reports and AI output generated for you are yours to use, subject to the rights of third parties in the underlying material.
The application records and processes information about other people: your clients, their customers, competitors, the owners of sites you audit and the people you contact in Link Builder. For that data the roles are:
- We are the controller of your account, billing and security data (see the Privacy Policy).
- You are the controller and we are your processor for the content you load about your clients and other third parties. The terms are in the Data Processing Agreement, which forms part of this agreement.
- You promise that you have a lawful basis for what you load, that you have given the notices the law requires, and that you have not loaded data you may not use. Do not send us sensitive personal data (health, biometric, political or similar) or payment card numbers.
12 · White-label reports and client access
You may present reports, share links and client access under your own brand — your name, logo and colours — and give your clients read-only access to their results. You remain responsible to your clients for what you tell them and for whom you give access; a share link works for anyone who holds it (and knows its password, if you set one) until you revoke it. You must not present the data as a measurement it is not (section 15), claim certifications or guarantees on our behalf, or use our name in a way that suggests we endorse your service. White-label output does not name our data providers, and you may not ask us to name them to your clients in our name.
13 · Third-party services
The service relies on third-party services — among them search-data providers, AI providers, Google, Microsoft, Shopify, Stripe and an email provider (see Sub-processors). When you connect a Google account, our use of what Google gives us follows Google's API Services User Data Policy, including its Limited Use rules (see the Privacy Policy). When you connect any other account, you must be allowed to do so, and that account's own terms continue to apply to you. We give no warranty for a third party's outage, change or decision, and a result that depends on a third party is only as good as what the third party returned.
14 · Intellectual property and feedback
The service, its software, design, documentation, names and logos, its scores and formulas, and the methods and prompts behind its assistant and ready-made skills belong to us or our licensors and are confidential where they are not published. Nothing in these terms transfers them to you, and you may not copy, extract or reverse engineer them. If you send us an idea or a suggestion, you allow us to use it without payment or obligation to you, and without naming you. Your content stays yours (section 11).
15 · Accuracy and AI output — read this one
Every number in this product is a measurement, and measurements have conditions. Selling them to your own clients as certainties is the fastest way to have an uncomfortable meeting.
- Rank data is a sample. A position is what one query, from one location, on one device, at one moment, returned. Search engines personalise results; a real person standing on that grid point may see something else. Two scans hours apart can legitimately disagree.
- AI answers are not reproducible. The assistants in the AI visibility feature are third-party models that do not return the same answer twice. A recorded mention is evidence that a model said something once, under those settings, on that date — not a prediction that it will say it again, and not a claim that what it said is true. Models state false things confidently, including about brands.
- Volumes, difficulty, traffic, ratings and competitor figures are estimates produced by third-party data providers or by our own models, not measurements of your traffic.
- Crawl results describe the pages we could fetch at that moment, under
robots.txtand the size and rate limits above. A page that was skipped is reported as skipped, not as clean. Scores such as AI readiness are our assessment against published guidance, not a ranking factor of any search engine.
AI features. The AI visibility feature, the assistant, the ready-made skills, Content Writer, the WordPress agent and parts of Link Builder use artificial-intelligence models of the providers listed on the Sub-processors page. Output can be wrong, incomplete, out of date or similar to other people's text. You must review it before you publish it, send it or rely on it; nothing in the service takes a decision about a person that has a legal or similarly significant effect. Some markets require text generated by AI to be labelled as such (for example the EU AI Act, Art. 50); whether and how that applies to what you publish is for you to check.
Accordingly: nothing produced by the service is a guarantee of any ranking, any traffic, any appearance in an AI answer, or any revenue. We give no such guarantee, and you must not pass one on to your own clients on the strength of this tool.
16 · Availability, support and backups
The service is offered on commercially reasonable efforts, without a service level agreement and without a promise of uninterrupted availability. Maintenance can take it offline; where an outage is planned, we give notice by email or in the application. Support is by email at {{CONTACT_EMAIL}}.
We take backups so that we can recover from our own failures. They are not your archive and are not restorable on request for an individual account. Your archive is the export button in your account screen, which produces a machine-readable copy of your data and can be used once every 24 hours. Use it before you need it.
17 · Suspension and enforcement
We act in steps. For a breach that can be fixed we warn first and say what to change; if it continues we suspend the account or the feature; for a serious or repeated breach, or one that the law requires us to stop, we terminate. We may suspend at once for unpaid amounts, for a breach of the Acceptable Use Policy, where required by law, or where the account is causing a technical problem for other users or for a third-party site. When we act we tell you what we did and why, unless the law forbids it, and you can reply to {{CONTACT_EMAIL}} to contest it; a person reviews the reply.
18 · Ending the agreement
You can stop at any time. To stop paying, cancel the subscription (section 7). To remove your data, delete your account from the account screen. Deletion is deliberately not one click: it asks for your password, asks you to type a confirmation word, sends a confirmation email, and then waits seven days before anything is actually removed. You can cancel at any point in that week. When a confirmed deletion is carried out we also stop any subscription from renewing; the current period is not refunded unless the law requires it. Export your data first: after deletion there is nothing left to export.
After the wait, your account and its data are deleted. What survives is an accounting record without your email or name (it keeps an internal account number), because a business has to be able to reconcile what it invoiced. Backups taken before the deletion still hold the data until they rotate out; the detail is in the Privacy Policy.
We may end this agreement on 30 days' notice, and immediately for a serious breach of the Acceptable Use Policy or of section 10. If we end it on notice you can export your data during the notice period and for 30 days after it, and we refund the unused part of anything you prepaid. Sections 6, 11, 14, 15, 19, 20, 24 and 25 survive the end of the agreement.
19 · Disclaimers and liability
To the extent the law allows, the service is provided "as is" and "as available", and we do not promise uninterrupted or error-free operation or that it fits a particular purpose. This does not remove any right that the law gives you and that cannot be excluded — for a consumer in the European Union or the United Kingdom that includes the right to a digital service that conforms to the contract.
Where you act for a business, we are not liable for lost profits, lost rankings, lost traffic, lost business or any indirect or consequential loss, and our total liability arising out of this agreement in any 12-month period is limited to the amount you actually paid us in the 12 months before the event that caused it.
None of this limits liability that cannot lawfully be limited — including liability for intent or gross negligence, for death or personal injury, and for fraud — and, where you are a consumer, none of it affects your statutory rights.
20 · Indemnification
Where you act for a business, you will compensate us for losses, claims and reasonable legal costs that third parties bring against us because of content you loaded or published, a crawl or an email campaign you started without the authority or the legal basis these terms require, or your unlawful use of the service — to the extent that you are at fault. This section does not apply to consumers.
21 · Changes to the service and these terms
We improve the service continuously, and features change. If we remove a feature that is a material part of a paid plan, or materially reduce a plan's limits, we tell you at least 30 days before, and you may cancel and receive a refund of the unused part of any prepaid period.
We may change these terms. Minor changes — clarifications, new features, changes required by law or for security — are published here with a new effective date. Changes that materially affect your rights, your price, or what we do with your data are announced by email at least 30 days before they take effect. If you do not accept a material change, you may cancel or delete your account before it takes effect and we refund the unused part of any prepaid period; that is your remedy. We do not change the terms retroactively for work already paid for.
22 · Acceptance of changed terms
When the text changes materially, the application shows a dialog and does not let you continue until you accept the new version or sign out. The version you accepted and the date are stored (and a salted hash of the network address, not the address itself).
23 · App store terms
Rankfinity is a web application, and it is also offered as a Shopify app and as a browser extension. The Shopify app is installed from the Shopify App Store, and Shopify's terms apply to that installation and to the charges Shopify bills. A browser extension is downloaded from the extension store of your browser, where it is published, and that store's terms apply to the download. These terms apply to the use of the service in every case. The service is not distributed through the Apple App Store or Google Play.
24 · Governing law and courts
This agreement is governed by the law of the Republic of Bulgaria, where {{COMPANY_LEGAL_NAME}} is established (section 1), and, for businesses, the Bulgarian courts have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory law of the country where you live and you may bring proceedings in the courts there; consumers in the United Kingdom may bring proceedings in the courts of the part of the United Kingdom where they live.
25 · Disputes and complaints
If you act for a business, please write to {{CONTACT_EMAIL}} first and give us 30 days to resolve it. A consumer can go to court or to a consumer or supervisory authority at any time. There is no mandatory arbitration and no waiver of class or collective proceedings in these terms. A consumer may also complain to the consumer-protection authority of their country (in Bulgaria, the Commission for Consumer Protection) and, for data protection, to the supervisory authority (see the Privacy Policy). We have not committed to take part in an out-of-court dispute scheme for consumers; if we do, this section will say which.
26 · Notices for specific regions
- European Union / EEA. Mandatory consumer rights apply notwithstanding these terms, including the rules on digital services that do not conform to the contract; the right of withdrawal is on the Refunds page.
- United Kingdom. If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 and the 14-day cancellation right under the Consumer Contracts Regulations 2013, as described on the Refunds page. Nothing in these terms affects them.
- California. A paid plan renews automatically for the period you chose, at the price shown in the plan list and at checkout, until you cancel; you can cancel online at any time under Billing, as described in section 7, and cancellation takes effect at the end of the period you have paid for. We email you before a plan renews (about 7 days before a monthly plan, about 30 days before a yearly one). Complaints may be sent to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. We do not sell personal information; see the Privacy Policy, section 11a, for the one consent-based exception (advertising signals on the marketing site).
- Elsewhere in the United States and in other countries. If a provision of these terms is not permitted where you live, it applies only to the extent it is permitted, and the rest of the agreement stays in force.
27 · Copyright and abuse reports
If you believe content shared through the service infringes your copyright, or that a shared report or page is unlawful, tell us how to find it and why, at {{CONTACT_EMAIL}}. The procedure and what we do are on the Copyright and abuse page.
28 · General
- Transfer. You may not transfer this agreement without our written consent. We may transfer it to a company that takes over the service, after telling you; your rights under it do not get worse because of the transfer.
- Events beyond control. Neither of us is liable for a failure caused by events outside reasonable control, such as a provider's outage, a network failure or a natural disaster, for as long as they last.
- Severability and waiver. If a provision is invalid, the rest stays in force. Not enforcing a provision at once does not waive it.
- Entire agreement. The documents in section 1 are the whole agreement on their subject. Nothing in it limits liability for fraud.
- Language. These terms are written in English. A translation, if we provide one, is for convenience; where they differ, the English text prevails unless mandatory consumer law requires otherwise.
